PLEASE CAREFULLY READ THE FOLLOWING LICENSE AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS IN THIS AGREEMENT, DO NOT USE THE TONYTREE PRODUCTS OR ANY OF THE PROVIDED FILES.

1. DEFINITIONS

 

• TonyTree is the author's CG project by Anton Levashov on creation the high-quality 3d models of the various elements of the digital natural environment.

• TonyTree Product (Content) - documentation, 3d models and 3d scenes, various raster images created by Anton Levashov within the framework of the TonyTree project.

2. LICENSE TERMS

 

• This is a license agreement and not an agreement for sale.

• Anton Levashov hereby grants you an ongoing, non-exclusive, non-transferable royalty free worldwide license to the digital TonyTree product for personal and commercial use, within the Authorized Use (as defined below). The product itself as well as the copy the product or any other copy remain the property of Anton Levashov at all times.

• You are licensed to use the product as many times as you like for any of the Permitted Uses defined below. You are NOT licensed to use the product in any other way. Any use of the Product that is not a Permitted Use shall constitute infringement of copyright. All other rights in and to the Product, including, but not limited to, all copyright and other intellectual property rights relating to the

      Product, are retained by Anton Levashov.

• You may install the content in only one location at a time, with a location being an physical office or workplace. As an example, companies with offices in more than one city or country should purchase the product multiple times.

• You can use the product in a new location, by installing its content there and uninstalling it and all copies of the product and included files on the old place of use.

3. PERMITTED USE

​

      You may use the product for the following purposes:

​

1. Advertising and promotional projects, such as CG visualizations, multimedia presentations, including film and video, commercials, broadcast and theatrical presentations;

2. Entertainment applications, such as books and book covers, magazines, newspapers, editorials, newsletters;

3. On–line or electronic publications, including web pages and/or internet broadcast;

4. Prints, posters, catalogues, brochures (i.e. a hardcopy) and other;

5. Any type of personal projects and/or artwork;

6. Any other uses approved in writing by Anton Levashov.

4. PROHIBITED USE

​

      The following uses are not permitted:

​

1. Use the product in applications intended for resale;

2. Incorporate the content in any product that results in a re-distribution or re-use of the content or is otherwise made available in such a manner that a person can extract or access or reproduce the content as an electronic file;

3. Remove any notice of copyright, trade-mark or other proprietary right from any place it has been fixed on or embedded in the content;

4. To resell, assign, publish or otherwise redistribute the product or any of its included files. Products can be used for private or commercial use and can be modified in any way in order to conform to your needs. However, any such modifications or changes are still derivatives of the original and cannot be sold or distributed as your own;

5. Use of this product (in particular bitmaps, presets, materials) for the creation of a texture, material library or as a texture / material library for any kind of product, plug-in, 3d application or other graphics software is strictly prohibited. Individual bitmaps, scenes, materials or presets may not be distributed (commercially or otherwise) alone or in combination with other products. Furthermore these bitmaps, materials or presets may not be repackaged in whole or in part as texture libraries, material libraries, online in material databases or user communities;

6. Install and use the content in more than one location at a time or post a copy of the content on a network server or web server for use by other users;

7. Copy or use the product or documentation in another way than permitted by this Agreement.

5. COPYRIGHT

​

• TonyTree products and TonyTree are protected by Russian copyright law and international treaty provisions. You agree that no title to the intellectual property of the TonyTree product or TonyTree is transferred to you. You further acknowledge that title and full ownership rights to the product will remain the exclusive property of Anton Levashov.

6. GOVERNING LAW

​

• This agreement shall in all respects be governed by and construed in accordance with the laws in force in the Russian Federation.

7. TERM AND TERMINATION

​

• This license agreement takes effect upon your use of the product and remains effective until terminated. You may terminate it at any time by destroying all copies of the product and included files or deleting all files and copies thereof from your harddisk. It will also automatically terminate if you fail to comply with any term or condition of this license agreement.

8. OTHER

​

• If any provision of this Agreement is found to be invalid or otherwise unenforceable,the further conditions of this Agreement will remain fully effective and the parties will be bound by obligations which approximate, as closely as possible, the effect of the provision found invalid or unenforceable, without being themselves invalid or unenforceable.

BY DOWNLOADING, INSTALLING AND USING FILES PROVIDED BY TONYTREE, YOU HEREBY AGREE TO THE TERMS AND CONDITIONS PRESENTED ABOVE.
